Lactalis, a staunch opponent of the Nutri-Score system, has succeeded in having the French Council of State refer its case to the Court of Justice of the European Union. The dairy group has never adopted this voluntary labeling system, which classifies products from A to E according to their nutritional quality.
The company is challenging the decree of March 14, 2025, which revised the Nutri-Score calculation method. It criticizes the system for failing to take into account actual portion sizes, for lacking transparency towards European authorities, and for classifying certain dairy drinks in a category with coefficients that differ from those of solid foods.
The Council of State is now asking the CJEU whether a Member State can recommend a graphic display to supplement the mandatory nutrition declaration, even if it does not separately detail energy or nutrients. It is also questioning the possibility of using a simplified format, such as a letter or a color code, and adding other nutritional information.
Lactalis confirms that the procedure is continuing at the European level.
According to the French Food Observatory (Oqali), the Nutri-Score is declining for the first time: the share of sales of products displaying it fell from 64% in 2023-2024 to 63% in 2025, due to the withdrawal of certain national brands.
